Punitive Damages Available Against the NavyThe U.S. government may be liable for punitive damages in Clean Air Act cases.This case, out of Florida's 11th Circuit Court of Appeals, held that the Navy could be liable for punitive damages under the Clean Air Act. The City of Jacksonville alleged the Navy openly violated CAA standards for over five years, and seeks up to $10,000/day in penalties, plus punies.
